Department of Homeland Security (DHS) Non-Compliance Letter
Many MCPR members have recently received a letter from the Department Of Homeland Security (DHS) in reference to potential non-compliance with Chemical Facility Anti-Terrorism Standards (CFATS). The letter states the ag retail facility in question "may possess one or more chemicals of interest (COI) that meets or exceeds the reporting threshold set by DHS in 2008. Of the facilities that received the most recent letter, several had previously registered with DHS. It appears this is a "blanket" letter from DHS to re-assure all required facilities have registered and completed a top-screen submission. If you receive this letter and are positive you have complied with the CFATS requirements from 2008, there are instructions in the letter to contact DHS and notify them of your compliance with the regulation. If you have not completed the registration and top-screen submission to DHS, do not hesitate, register and submit information to DHS as soon as possible. For those of you following the incident in West, TX, that ag retail facility failed to register with DHS and submit top-screen information.
